Hannun calls for legislating second amendment to Integrity and Illicit Gains Law

    The head of the Commission of Integrity COI, Haider Hannun, called on Wednesday to legislate the second amendment to Integrity and Illicit Gains Law, indicating that amending the law will achieve five important means.
     
    Hannun said in a speech during the celebration of the Integrity Week, attended by the Iraqi News Agency (INA), that "COI, a year ago, put in its creed that national project, to implement with all professionalism its duty to combat corruption, prevent its spread and recover its revenues in interaction with the government program that put the fight against corruption a priority, and in light of governmental, parliamentary and judicial support, as well as to prepare for the corruption battle that is approaching, and one of its requirements is the legislation of the Second Amendment to the Law of the Integrity and Illicit Gain law No. (30 of 2011) amended which will make the Federal Integrity Commission a more active soldier in this battle."
     
    He explained that the second amendment to the law will include 5 important means:

    First: The head of the Commission shall issue the decision to prevent travel and seize movable and immovable property against anyone who is suspected of corruption and fears his escape or smuggling of his money, provided that a decision is obtained from the competent investigation court to support it within (72) hours from the date of its issuance, otherwise the travel ban or seizure of funds is automatically canceled with the lapse of that period, and through this, we will be able to prevent the escape of those suspected of corruption or smuggling of looted funds, taking advantage of the of time taken by process of the judicial decision.

    Second: The head of the Commission shall file lawsuits before foreign courts to demand the recovery of funds or the extradition of wanted persons, and contract with investigation companies, law firms or persons to track smuggled funds and fugitive convicts, as an exception to the legislation in force, due to the importance of this in tracking and searching for such funds, taking into account detecting and recovering them, and the fact that that they have been settled in secret accounts or unknown economic institutions that cannot be inferred without the intervention of specialized research agencies and the investigation of funds in those countries.

    Third: The establishment of the Inspection Department: which undertakes tasks close to the tasks of the abolished offices of general inspectors, based on the abolition of the General Inspectors Law, the matter that led to ending the Federal Integrity Commission's supervisory authority in ministries and entities not related to a ministry and the rest of the institutions, and giving a wide space to blackmail officials and employees.


    Fourth: Giving the Commission the authority to direct any employee or person charged with a public service to reveal his financial disclosure, as well as anyone suspected of having funds originating from corruption or unknown origin, through which we will be able to recover the funds looted in all past years, through the campaign (Where did you get this) [to pursue] inflated funds and illicit gain.

    Fifth: The final judgment in one of the corruption felonies entails the dismissal of the employee from the job, and the termination of the service of the person charged with a public service, whether appointed or elected, and his inclusion in the general or special amnesty does not prevent his dismissal or termination of his service, and through this, we will be able to get rid of employees or those charged with public service who have been proven to be corrupt, and not to return them to the job or public service.

    He continued, "Preparing all parties related to this battle, to enter into it in a real and effective manner," noting that "until then, the Federal Integrity Commission will continue to exert maximum efforts in the fight against corruption, and achieve unprecedented achievements."
