The president of the Supreme Judicial Council-SJC, Judge Faiq Zidan, confirmed on Friday, forming a specialized commercial judiciary to achieve the economic development of the country.
“A judicial delegation headed by the President of SJC, Judge Faiq Zidan, participated in the Standing International Forum of Commercial Courts- SIFoCC- held in the Australian capital, Sydney, in the presence of the heads of the Judicial Councils of the member states of the Forum, in addition to the heads and judges of the commercial courts of the member states, while the Iraqi judicial delegation included The judges of the Commercial Court in Rusafa , Taghreed Abdul Majeed and Ibrahim Kamel,” said SJC in a statement received by The Iraqi News Agency(INA).
Zidan delivered a speech in which he affirmed that" Since the establishment of the Iraqi state, the Judiciary has been part of the executive authority, and its gained the full independence from the rest of the authorities in 2003, that independence was enshrined in the Constitution of the Republic of Iraq of 2005. To cope with the accelerated growth in Iraq's economy and the active need to provide innovative, fair and transparent judicial services, and for the purpose of encouraging and attracting foreign investors to work in Iraq in a business-friendly environment, we formed specialized commercial court for the purpose of enshrining the principle of subjectivity of trade law in order to contribute to the economic development of the country. "
He continued, "Iraq has ratified the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards by Law No. 14 of 2021, and the Convention entered into force after Iraq deposited the third instrument of ratification for accession. Thus this Convention is considered effective and enforceable on February 9, 2021".
He pointed out that "The Iraqi Supreme Judicial Council has not overlooked the important role played by women and the necessity of empowering them within the judicial institutions, as the recent years have witnessed the participation of a number of women into the Judiciary institutions, and the Supreme Judicial Council adopts the methodology of empowering women to assume judicial tasks and positions. The task, including the Commercial Court, the Financial Services Court, and others, and it is appropriate to state that the President of the Commercial Court in Baghdad / Rusafa is a woman who attending this forum, and she presides the Financial Services Court.”
